Online Product Availability

Cruikshank makes every effort to keep a sufficient inventory of the products offered on its website. However, the availability of these products changes daily and is not guaranteed.  If Cruikshank is unable to deliver a product ordered through www.firebrandnz.com, the buyer will be notified accordingly by e-mail or telephone. If such is the case, any amount charged to your credit card for products, including delivery charges, if any, will be credited as soon as possible. Cruikshank waives any liability in the case of inventory shortages.

Pricing Policy

All prices quoted on www.firebrandnz.com are in New Zealand dollars.   Cruikshank reserves the right to modify the prices of products available on its site at any time, without prior notice.

Shipping Information

Orders received will be sent within 7 working days subject to availability of stock.

All items will be sent by courier and a signature may be required on receipt.  We are unable to deliver to Post Office Boxes or Private Boxes.  We may be unable to ship to some rural destinations, or in some situations this may incur an additional fee.  If this is the case, you will be contacted to discuss options for your order.

Delivery Charges and Services

At Cruikshank, we strive to arrange delivery of your purchase in the quickest and most economical way possible. We review each order individually and factor in destination, weight and size of items. Shipping charges and delivery methods with the exact shipping amount for your order will be calculated and displayed at Checkout.

Secure On-line Payments

We have taken every reasonable precaution to ensure that the personal information that you provide us is safe and secure.

We do not store your credit card details.  If you like to order something from our on-line store and prefer to make payment by telephone for a purchase please call us with the details.

Payment Options

Credit cards and Paypal are the forms of payment accepted when buying on www.firebrandnz.com . We accept Visa and MasterCard credit cards.

All credit cardholders are subject to validation checks and authorisation by the card issuer when you place your order.  If the issuer of your payment card refuses to, or does not, for any reason, authorise payment to use, we will not be liable for any delay or non-delivery.  Card payments will be debited and cleared from your account when your order is processed.

Refund Policy

Customer satisfaction is very important to us – we want to make your online shopping experience as satisfactory as possible.  All merchandise is inspected prior to shipping and in the event that there is a problem upon receiving any order please contact us within 21 days of purchasing the product to resolve the issue.

Incomplete Order

In the event that we are unable to deliver a product  we will contact you as soon as possible.

Defective Product or Damaged Item(s)

If you have any concerns with regards to your purchase, please contact us to discuss these concerns.

All Cruikshank products undergo rigorous quality control inspections before they are packaged for delivery.  If for some reason an item arrives at your doorstep damaged we will replace it for you at no cost.  If in the event of a defective or damaged item(s) please  return the defective or damaged product to our store at 50 Buckingham Street, Arrowtown 9302, New Zealand.  The item(s) must be returned to us within 14 days. Presentation of the proof of purchase is required to obtain a refund or an exchange.  Cruikshank will reimburse the portion of delivery charges relating to a defective product purchased online. All refunds will be credited to the customer’s credit card unless otherwise agreed.

If the goods are faulty, we will meet our obligations under the Consumer Guarantees Act to provide a remedy.

Use of This Website

You are provided with access to this Website in accordance with these terms and conditions and any orders placed by you must be placed strictly in accordance with such terms and conditions.

We reserve the right to modify or withdraw, temporarily or permanently, this website (or any part hereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website; and/or change these terms and conditions from time to time, and your continued use of the website (or any part hereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the terms and conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the website

Contract, Order Acceptance and Cancellation

The technical steps required to create a contract between you and Cruikshank are as follows:
(a) You place the order for your products on the website by pressing the ‘Proceed’ button at the end of the checkout process.
(b) We will send to you an order acknowledgement email detailing the products you have ordered.  This is not an order confirmation or an order acceptance from Cruikshank.
(c) Order acceptance and the completion of the contract between you and Cruikshank will take place on the dispatch of the products ordered, unless we have notified you that we do not accept your order, or you have cancelled it before dispatch.  The sales contract is within New Zealand law.

We may not be able to accept your order or part of your order for one of the following reasons:
(a) The product you ordered is out of stock;
(b) Authorisation of your payment failed;
(c) We made a pricing or product description error; and/or
(d) You are not eligible to order from Cruikshank
If there are any problems with your order, we will contact you.

If you change your mind about an order that you have placed with us, please contact us immediately by emailing design@cruikshank.co.nz.  Orders are usually processed immediately after you place the order, so we may have already packaged your order and made arrangements for it to be sent to you if you cancel it.  If this is the case we cannot always stop the order from being sent.


Product Descriptions

Each item purchased is sold subject to its product description. We take all reasonable care to ensure that all details, descriptions and prices of products appearing on www.firebrandnz.com are correct. However, some information, including product descriptions may not always reflect the position at the moment you place an order.


You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your shopping account and/or your personal information.

We have a very particular set of skills; skills we have acquired over a very long career.  If you rip off our stuff, we will find you and take the necessary steps to stop any intellectual thieves.

Limitation of Liability

Cruikshank’s total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Cruikshank to the customer, together with any shipping costs incurred. Cruikshank shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way. Cruikshank cannot accept any liability for a failure to comply with specific instructions stated in any catalogue or on the website.
